TIGTA Reports
The IRS Must Do More to Address Noncompliance and Potential Misconduct With Return Preparers (Report 2027-IE-R001)
October 21, 2026
TIGTA found that in Processing Year 2025, more than 38,000 return preparers with a noncompliant PTIN status (for example, expired) prepared over 2 million returns. Nearly 12,000 of them filed about 95,000 Forms 1040 claiming nearly $600 million in refunds. TIGTA also found that PTINs were issued or renewed for ineligible preparers (73 for deceased individuals and prisoners), and that 691 IRS employees held active PTINs, more than 90 of whom may have prepared returns for compensation. Returns bearing an overstated withholding scheme for Tax Years 2023 and 2024 requested about $740 million in refunds (about 84 percent from uncredentialed preparers), including roughly $179 million prepared by ghost preparers.
Practice impact: TIGTA made one recommendation, with which the IRS agreed: finalize and implement its data-driven return preparer strategy, addressing preparer outreach and penalties, employee PTIN policies, scheme promoters and ghost preparers. The IRS has limited authority to regulate uncredentialed preparers; enrolled agents, CPAs and attorneys are subject to Circular 230.
