Treasury, IRS Provide Gift Tax Safe Harbor for Trump Account Contributions

The Treasury Department and IRS issued Revenue Procedure 2026-25, providing a gift tax reporting safe harbor for certain contributions to "Trump Accounts" — the tax-advantaged savings vehicles for children under 18 created under Section 530A by the Working Families Tax Cuts (One, Big, Beautiful Bill). Under the safe harbor, qualifying cash contributions made before the beneficiary turns 18, up to the annual gift tax exclusion amount ($19,000 for 2026), are treated as completed present-interest gifts and do not trigger a Form 709 filing requirement.

What this means for your practice: Clients contributing to a Trump Account on behalf of a minor generally will not need to file Form 709 for those contributions, provided the contribution is the donor's only reportable gift to that beneficiary for the year, stays within the annual exclusion, and no gift tax return is otherwise required. Confirm all safe-harbor requirements are met before advising a client to skip the filing.
